Adams recall may not be dead after all

November 24th, 2009, 4:41 pm · 45 Comments · posted by Martin Wisckol, Politics reporter

The effort to recall Assemblyman Anthony Adams, R-Hesperia, was pronounced dead by Secretary of State Debra Bowen on Friday, but recall advocates today found cause to hope for a revival.

Recall leader Mike Schroeder of Corona del Mar said some of the rejected petition signatures thrown out may indeed be valid, although elections officials stood by their finding that insufficient valid signatures were submitted.

A sample of petition signatures for the recall found large numbers of invalid signatures, and elections officials projected that only 24,579 of the 58,384 signatures were valid. A total of 35,825 valid signatures were needed to qualify a recall in Adams’ district, which straddles Los Angeles and San Bernardino counties.

Recall proponents began today going through the 678 invalid signatures tagged in the sample in San Bernardino County, where the invalid rate was projected at 65 percent.

According to Schroeder, they may have found a number of signatures in the 40 or so they examined that should have been counted and were not. He said they will continue to go through signatures Monday to determine if there are indeed enough valid signatures.

However, San Bernardino County Registrar of Voters Kari Vergil said there were no irregularities.

“We are beyond confident,” Vergil said.

Schroeder and Lee Lowrey, also of Corona del Mar, led the charge to recall their fellow Republican because Adams was one of six state legislators who joined Democrats in approving a February budget update that included tax hikes. Recall advocates say Adams betrayed his signed pledge not to support more taxes.

Among the irregularities cited by Schroeder in the signatures examined today were 11 that were disqualified because the voter had registered after having signed the petition. Schroeder said that further examination showed that the 11 had registered to vote the same day as they signed the petition, and should have been counted.

Vergil countered that the registration cards were indeed received after the date the voters signed the petition.

Schroeder also took exception to eight signatures from voters in the district that were disqualified because no address was given. Additionally, he said he was concerned with how duplicate signatures in the sample were projected out to calculate the total number of invalid signatures.

Vergil said addresses must be included on the petitions in order for the signatures to be valid.

The calculation projecting the number of valid signatures is not a straight one-to-one equation. In San Bernardino County, 49 percent of the 1,339 sample signatures were found to be valid, but just 35 percent of the 44,590 signatures were projected to qualify.

Schroeder said today’s irregularities were probably inadequate to qualify for the recall, but that more such issues could result in the recall hitting the ballot after all.

More hanky panky stuff. What do you expect? Integrity??? Honesty??? Straightforwardness??? You won’t get it from Sacramento. I am beginning that one of the prerequisites to work in state politics is to be a prerequisite liar. It’s impossible to get a straight answer from anybody up there. CYA all the way!!!

    • rob says:

talk, talk ,talk. From what I see if you can’t repeat something Rush or Glenn said you just rant on and on. do you have any useful info. of your own?

      • Brian says:

Do you have any useful complaints, or do you just need any excuse to say Rush Limbaugh or Glen Beck as if they have a negative connotation associated with their name? Maybe to you and the rest of the ‘hate America’ crowd they do, but to patriotic Americans who care about their country they don’t. Maybe you should just go back and have another drink of koolaide and continue to be duped by the state run media and the liars in control of Congress and the White house. You sound like one of the people that complained nonstop when Bush was in office, but as soon as someone with a D next to their name took over all those complaints stopped. That’s called political bias and complete hypocrisy. Now go eat your turkey dinner, before total socialism takes over and you’re forced to give up half your food or be taxed to death or jailed.

  • stinkyone says:

You get none of the above! We need to get them Turkey’s out of there!

  • Donkey says:

What it seems to be is the government lacky’s protecting one of their own that voted with the tyrants to continue to steal from the taxpayers.
I hope this clown is recalled and I hope he is replaced with a citizen with integrity.

  • stinkyone says:

We need to get back to the basic. One day with all of us, we can make this a better place to be.

  • Baseball Fan says:

So sick of Schroeder. Who died and made him King? His day is over. He is morally and ethically bankrupt.

  • SEESAW says:

For god sakes, losers! Call it a day. Even if you overturn the decision that there were not sufficient signatures, the election would still have to be scheduled and funded. It might not even be completed by the time of the primary election in June. And, to accuse the workers in the respective County Registrars’ offices of fraud is really uncalled for. You are grapsing at straws. End the charade already!

    • ocobserver says:

      seesaw,

oh i see. so just throw election law and the democratic republic and that pesky constitution out the window for the convenience of the government, eh??

      are you nuts or what??

      • stinkyone says:

No he is a lib. and a dumb one too! LOL!!! They are all dumb

      • SEESAW says:

I am a moderate–not a lib. I am not saying, “Throw election law out the window”. The law has been followed, as far as we know, and the results have been announced. You have no evidence and no reason to be accusing the public workers of committing fraud in this situation. So, stop belly aching and start paying attention to the coming slate of candidates for the June 2010 primary election.

        • ocobserver says:

          seesaw,

you’re a fool. John and Ken will get to the bottom of this. You don’t get a 34% validity rate on San Bernadino petition signings when all the signatures were checked and verified with a 71% validity rate by the contracted petition company BEFORE they were submitted to the Secretary of State’s office without hanky panky going on.

And when the TRUTH is exposed you will run away like a scared rant with its tail between the legs!!!

Anothony Adams is a verified LIAR and BETRAYOR. During his campaign he SIGNED a PLEDGE to get his constituent’s money and votes. Once elected he BETRAYED them by doing the exact opposite (voting for the BIGGEST tax hike in the nation’s history!) Adams is not fit for office. He LIED and by doing so STOLE money and votes from his supporters.

  • HighDesertLady says:

The people deserve answers. The integrity of the count is crucial. There is continues to be a lack of confidence in the registrar. Registrar Kari Vergil has been suspect in past elections and was hired by disgraced supervisor-assessor Bill Postmus. The accuracy of the vote has been questioned in at least two major elections in this county in the past four or five years!
    Power to the people!

  • Warren says:

Why don’t these two dead beat attorneys let it go? They lost. Please not another recount.

    • Voter says:

Because the signiture gathering company guarantees their validity and there has never been a recall petition turned in anywhere with only 35% validity.

This was either the worst run signiture gather effort ever or fraud.

  • Lori says:

Who’s PAYING for the re-count and attack on this OUT OF TOWN Assemblyman?

If it’s from the G.O.P. coffers, I think SOMEONE (Scott Baugh or better yet, someone with some guts at Republican headquarters) should pull the plug!

Of course they won’t because they’re all good old boy’s snuggled up into one big bed together…

Hey Mike Schroeder YOU LOST…give it up and MOVE ON…why don’t you find something useful to do…like find out why our Republican Governor is taking this STATE down the tubes!

No, that would be too much work wouldn’t it Mikey? You and your bullies would rather go after something softer…WHAT A JOKE YOU GUY’S ARE.

Mike Schroeder, Scott Baugh, Dicky Ackerman, Dave Ellis and the rest of their cronies are like the walking un-dead from a low budget ZOMBIE movie…they keep moving because no one’s told them they’re POLITICALLY DONE, IRRELEVANT…Get over yourselves boy’s and lay down already, no one wants to hear from you anymore.

  • MVAgusta says:

    Lori,

You are such a political hack or at least some form of political operative. How is challenging suspicious irregularities that undermine the electoral process and silence the voters anything but the a good thing for the constituents? Your posts make it obvious that you are not merely a common poster, but some form of hack trying to smear the campaign. I smell the fat and disgusting Adams all over this.

    • Lori says:

      Wrong MVAgusta…

I am an average, every day citizen who has watched the THUGS of this county throw their mud and use G.O.P. contributions to gain power for themselves.

This Grandstanding by Schroeder and his ilk is not for YOUR benefit…it’s for HIS.

He didn’t do this because Adams voted the wrong way, he did this to make himself relevant again and it isn’t working. He started the “eat your own” campaign to enable himself to hang onto the last grasp of the title of “King Maker”… but it is slipping away from him due to his out sized EGO and a maniacal sense of entitlement.

You truly are giving me far too much credit. A political hack would not be as obvious as I am in my disdain for the “good old boy” network here in Newport.

The Republican Party of Orange County would elevate their status if they relegated these guys to the dust bin of washed up, out dated politics. The public is sick of their abusive campaigns pitting Republican against Republican.

Wake up Schroeder…it’s a new day.

    • 45yrsinoc says:

So they want to spend $1 million, in the middle of a fiscal crisis, on a special recall election to oust a guy who’s seat is up for grabs in June 2010? And these are supposedly “fiscal conservatives”? These idiots are just a half-step behind the birthers when it comes to stupidity.

      • Sammysam says:

At least it keeps it in the press until election time so the voters know the program come election time. Besides which if there are irregularities out there on the part of the ROV it definately need to be known.

      • Brian says:

This guy was effectively the deciding vote to raise our taxes $16 Billion! Spending one million to oust him is chump change compared to that and the billions the state wastes every year.

        • 45yrsinoc says:

His seat is up for grabs in June 2010. What’s the point of spending the money to hasten the process by 2-3 months at best?

You might as well just flush the money down the toilet.

  • Voter says:

Count the signatures. Stastitical sampling denies the will of the voters.

    • SEESAW says:

The sample estimate has to reach the 95% point, and it did not.

And, to OCO, how about the recall petitions being signed on the same day that the signers were also registered to vote. That’s real interest in our electoral process and our constitution. I’m sure those respective signers would have been first in line at the polls on recall election day. The OC organizers and John and Ken should be run out of this State!

      • ocobserver says:

The petitions signed in San Bernadino were VERIFIED as VALID by the petition company contracted to do the job. Those signers were ALREADY on the voter rolls, fool. The validity rate was 71% prior to submission to the Secretary of State’s office. Then the validity rate MYSTERIOUSLY fell to 34%. hmmm.

But naturally people like yourself don’t want the truth. You want to subvert not only the electoral laws, but our very constitution if they interfere with your PERSONAL ideological convictions!! HAH! Move to Red China, buddy. You’d be much happier there.

        • SEESAW says:

I welcome the truth–just bring it on. I’m waiting. And, don’t worry about me running away if you prove me wrong. I am afraid of no one, including you. If any of these election officials are found guilty of fraud, I will be the first to call for their heads.

You didn’t have anything to say about signatures and registrations being collected at the same time did you. Talk about subversion of the electoral process. Those people did not care about Anthony Adams. They are the types that will put their signatures to anything held in front of them. You still can’t get in through your head that this is not a situation that should trigger a mob hissy fit and a recall. You are just a whiny, miserable person. Maybe you are the one who should move to Red China.

        • ocobserver says:

” You still can’t get in through your head that this is not a situation that should trigger a mob hissy fit and a recall”

I would expect a comment like that coming from a lemming party hack like yourself.

Adams LIED by signing a NO-TAX pledge for his supporters during his campaign. By doing so he STOLE votes and money. That is clearly subverting the american political process and our democratic form of government. If we can NO LONGER trust the campaign statements made by people running for office we cannot vote intelligently and elect the ones who have our interests at heart. You are encouraging LIARS and THIEVES to run for office. And that tells us all we need to know about YOU. hah.

      • Brian says:

They followed the law. If you don’t like the law then you should do something about it, not cry like a baby because people choose to act upon their rights.

If you don’t like John and Ken, don’t listen. You won’t be missed. There will still be millions who do listen every day as they expose our corrupt government.

    • Rcon1 says:

Writ of Mandate should file immediately

Statistical sampling if challenged in court I believe will fail as volatile of a eighth amendment equal protection clause of the US Constitution. Every person who filed a petition to the government that wasn’t counted (97%) via Statistical sampling has been disinfranchised by there vote not counted. The petitiners right to be counted is absolute if the petitioner is a citizen of the county, registered to vote. (a address is not nessesary to vote)

You Lawyers running this know full well these facts and must file a writ of mandamus in state court today forcing the secretary of state to count ALL the petitions. It may be advisable to request the court take posetion of the ballots.

  • Brian says:

They have enough signatures, but what the ROV is doing is running the signed petitions through first and then running the registrations later. Then saying they aren’t registered, even though these people registered at the same time so there would be no question of them being registered or not. Next, they are using some regulation that is not part of the election law and any judge would though out. There are 6 duplicated petitions where the same people signed twice. Only 6, but they count them as something like 1,200 invalid signatures. ABSOLUTE JOKE.

I have no double when they go through the 600+ petitions they said where invalid that they will find otherwise. The ROV is going to be sued, if they do not turnover their false findings.

    • SEESAW says:

I am not encouraging liars and thieves to run for office. I do not approve of people signing a recall petition and registering to vote on the same day. Those are not people who are really concerned about our electoral system. People should study the candidates and the issues before they ever sign a petition or cast a vote.

      • ocobserver says:

        Seesaw.

How is one supposed to know that a candidate is LYING to them??? Do you expect the electorate to be MIND READERS??? Lying to constituents in a political campaign should be considered no less serious than lying on the stand in a criminal trial. And both should be punished equally. When the electorate can no longer trust the promises and word of those running for office our democracy is finished. We cannot tolerate LIARS being elected to political office. They are subverting our democracy.

      • Voter says:

There is nothing wrong with having an event to register new voters and also gather signitures.

  • Regardless of the outcome of the recall, I, Michael Rogers will be challenging Anthony Adams (or whoever wins if/when a recall election occurs) in the June 2010 primary.

Very briefly, I am a high school teacher who practiced law for 4 years prior to entering teaching. I have no prior political experience, no ties to any special interests, and no ties to the party machine. I am simply a regular guy who sees only corruption and incompetence in Sacramento, and I want to change it. More importantly, our State NEEDS me to change it.

Democrats have been beholden to the unions, but Republicans, frankly, have been worse. Republicans lack leadership. Can anybody explain why Adams (and 2 other Repubs) voted for the tax increase, while every other Republican voted against it, then every Republican in the Assembly gave Adams a vote of confidence and support? Why didn’t ANY Republican in the Assembly call Adams out about his vote, if he was in such the minority within his own party on it? Answer: they all cooked this up to cave in to the Democrats and hike up taxes. They got together and tried to decide which Republicans lived in Districts with constituents who they (mistakenly) believed were either too dumb or too ideological to oust a particular Assemblyman. Adams drew the short straw. Unfortunately, he lacked the leadership and integrity to stand up to his own party. For his weakness (and not just for “voting to raise taxes”), he needs to go. He is not a leader.

When I am in Sacramento, this type of thing will NOT happen without everybody outside the Capitol hearing about it. It is my belief that the Democrats continue to ram-rod tax hikes and spending sprees down our throats because the Republicans in Sacramento lack the leadership needed to stop it, then fall back on their “minority status” in the Legislature as their excuse.

We need A LOT of change in Sacramento. My goal is not just to replace Adams. My goal is to fix a lot of the problems that Republicans have allowed the Democrats to create.

For information on my candidacy, please visit my website at http://www.rogersforassembly.com. Thanks.

  • ocobserver says:

Michael Rogers, may the good Lord bless your soul, sir. We need more grass roots citizens and ‘non-politicians’ getting involved in the bid for political office. But you know the problem you face, my friend. I don’t need to tell you. I didn’t see a political party affiliation anywhere on your website. So I assume you are an independent. The dems and the republicans have designed a system in which they work together to lock out all candidates from opposing parties. It is a game of money and endorsements. One is practically forced into holding his nose and comingling with thieves and liars to have a fighting chance at being a contender. Unfortunately politics does awful things to people. It turns them into scoundrels who would stoop to the lowest levels to achieve money and power. Just look at what happens up in Sacramento. One scandal after another. They tell us one thing and do another. No one can be trusted. That is why they have an approval rating in the teens. The citizens can’t stand them. Phoniness thrives. The only way we can overcome this is by electing butchers and bakers and candlestick makers to political office. But the system they have designed for their own self-survival does not permit this. You have to be in the special club to be a contender. But as things get worse in the economy and the our quality of life continues to erode folks like you will have a fighting chance, Michael. The detached citizens will have to get involved in the electoral process for their own survival. At that point folks like you will begin to get better results. We just haven’t reached that point yet. We will. Be patient. I will be watching this race closely. Anthony Adams is a snake and needs to be removed from office. I don’t live in that district but I will donate money and volunteer my time to help the right candidate to remove him. I wish you all the luck in the world. God bless you and your family during the holidays and in 2010 (you have a very handsome family, btw).

  • Voter says:

I do not believe that “they followed the law.” This reeks of election fraud.

  • ThrowThemALLout says:

There seems to be an irregularity with this recall and I think someone is gaming it. Adams MUST be sent packing!!

  • Erin says:

Let’s see, Mike Schroeder, Mike Carona’s king defender for life and OC political thug now wants to impact another race? Somebody stop this idiot.

Too bad we can’t count on the Perez Hilton of Orange County, Scott Moxley on this one. I think he and Schroeder’s wife must share the same purple pumps.
