Appeal filed on Obama birthplace lawsuit

The allegations that Barack Obama is not a natural-born citizen and so is not legitimately president continue to percolate, with an appeal filed Monday with the 9th U.S. Circuit Court of Appeals.
U.S. District Court Judge David O. Carter on Oct. 29 dismissed without trial a civil suit seeking to disqualify Obama as president. Click here for the story. Laguna Niguel attorney Orly Taitz, on behalf of 42 of the 44 plaintiffs in the case, then filed with Carter a fiery motion for reconsideration. Click here for the story.
The two remaining plaintiffs, Buena Park Pastor Wiley Drake and American Independent Party Chairman Markham Robinson, had a falling out with Taitz and hired lawyer Gary Kreep to represent them. Kreep has filed the appeal on their behalf.
Also percolating are affidavits filed by a man who claims to have been Obama’s lover - Larry Sinclair - and another who says he has Obama’s Kenyan birth certificate - Lucas Smith. Both allege that Taitz told them to lie to the court. Those allegations could be considered by the state bar, which is already expected to look at Taitz’s misconduct that resulted in a $20,000 sanction from another federal judge. Obama can end this whole controversy straight away. Simply provide the court with a copy of his real birth certificate. Not a “certificate of live birth” because it’s not the same thing. Then all future lawsuits can be thrown out because it will be established that he is a citizen, “if he actually is”.

My 2nd son was born in Amman, Jordan, while I was with the State Dept there. His real, original birth cert is in arabic. I had to take the cert to the embassy consular office and get them to issue a “cert of live birth” which was required to prove my son was a “natural born citizen” of the US.
This is the first I’ve heard that Obama only provided a cer of live birth, and not his actual birth cert. Is that true?
The only time you get a cert of live birth is when you are born outside the US, but of at least one US citizen parent. If you are born in any US state, you just get a birth cert. If Obama truly produced only a cert of live birth, then he was not born in Hawaii, which became a State in 59.
He may still be a citizen if his mom was a US citizen, but he sure wasn’t born in Hawaii.
I just went back and reas the court’s decision to dismiss. The court dismissed because it did not have the power to dismiss a sitting president no matter what the facts were to show. So the court did not examine any facts or documents, and made no ruling as to facts.
How did he get a “certificate of live birth” from Hawaii?
By being born in Hawaii.

The Associated Press has said that they never wrote the “Kenyan-born” part and that they have repeatedly reported on the validity of Obama’s Hawaiian birth documents. This is a media myth, Martin. The Hawaii Department of Health has said they have an original birth certificate on file, but have NEVER said the document posted by Obama on his Web site is valid. Any suggestion of validity is an invention on the part of reporter’s who are appallingly incurious to do any real investigation to find out the truth.
While it is true that Hawaii never said the COLB on Obama’s birth certificate is valid, they did say that Obama was born in Hawaii. So what’s your problem?
Dr. C, they didn’t say Obama was born in Hawaii. Dr. Fukino claimed she saw vital records (plural) that verify he was born in Hawaii. This is problematic because the vital records that prove place of birth are birth certificates, yet she carefully avoided citing the birth certificate as being the source document that verifies where he was born. IOW, her statement is toothless because it’s not based on birth records.
Also, she’s not legally allowed to talk about information contained in the vital records maintained by her office (birth, death, marriage and divorce), which means she has to be citing some other vital records … maybe a drivers license, which isn’t they type of record that is legally recognized to prove the place of birth.
Under HRS 338-18(d), she could release index data related to the certificate number in the document photographed by Factcheck.com. This information is supposed to be available to the public, yet for unknown reasons, the DOH refuses to do so. One wonders why, because it would a direct way to verify the legitimacy of the COLB.
I forgot. There’s one other problem with Dr. Fukino’s statement about Obama allegedly being born in Hawaii. It says the vital records show that Obama was a natural-born American citizen. There’s no legal document I’m aware of that verifies this classification of citizenship status. It’s either Fukino’s opinion or an outright lie, which then calls into question the rest of her statement. Just show the original birth certificate. It has significant historical value and Obama should have no reason to claim privacy. He is the most public figure in the free world.

Obviously the AP got their information about Kenyan-born from somewhere, didn’t just arbitrarily make it up (how could you make up something like that?) Wonder what the source would have been, but hey we’ll probably never know since it’s been long buried by now.

Stan, the birth announcement in the newspapers did not list the place of birth nor the name of the child. When questions first emerged about Obama’s nativity, these were the two main issues being questioned. There was suspicion that his middle name was Mohammed and that his place of birth was NOT in Hawaii. Rather than release an original birth document with verifiable details, Obama mysteriously released a jpg of a redacted birth abstract dated June 2007. Don’t preach about gullibility, when your argument is lacking.
I saw that DVD “The Obama Deception” and yes IT IS SCARY right now, and it includes BOTH parties…not just the Dem’s.

Orly is a whack job. She should be disbarred for making a mockery of our judicial system. However, the “birth certificate” from Hawaii is actually a Certification of Live Birth. This is used to record a birth certificate from anywhere in the world. This cannot be used to verify United States Citizenship. The United States Department of State will not accept it when applying for a United State Passport. If Obama has nothing to hide, then why not simply provide a bona fide BIRTH CERTIFICATE that established he is a United States citizen?
It is strange that during the campaign, Obama tried to get Sen. McCain disqualified on the grounds that Sen. McCain was not a United States Citizen since Sen. McCain was born in a military hospital on a United States military base in the Panama Canal Zone. Well, he lost that one since it was proven that Sen. McCain was a United States citizen.

Obama’s Certification of Live Birth is based on the official record of the state of Hawaii. State officials reviewed the originial birth certificate, issued by the hospital like all birth certificates are, and certified his live birth in the State of Hawaii. It’s really not that hard if you try. Come on, you can do it.
Next, Obama NEVER raised McCain’s citizenship as an issue. He didn’t lose anything because he never contested anything. You need to get your facts straight sparky before you argue with the adults.

They have not stated they have seen a birth certificate issued by the hospital or any contents of the original birth certificate. Helps to get the facts straight.
