Obama birthplace lawyer fined for legal misconduct

A Georgia federal judge today fined Mission Viejo lawyer Orly Taitz $20,000 for legal misconduct in her claims that Barack Obama was born in Kenya and so should be removed as president.

In sanctioning Taitz, U.S. District Court Judge Clay D. Land wrote that one recent Taitz response to the court “is breathtaking in its arrogance and borders on delusional. She expresses no contrition or regret regarding her misconduct. To the contrary, she continues her baseless attacks on the Court….”

Taitz responded to Land’s order defiantly, saying she would appeal the sanction and continuing her attacks on Land.

“This is a travesty of justice,” she said. “It’s obviously a biased judge. He’s scared to go against the regime.”

Taitz called the Obama administration “the most repressive regime” the United States has known.

Land has dismissed two cases filed in his court by Taitz, who sought to prevent two members of the U.S. armed services from being deployed with the argument that Obama is an illegitimate commander in chief. He also threatened to sanction Taitz last month if she didn’t stop what he called “frivolous” filings. Click here to read about that.

Taitz currently has a case in Santa Ana federal court challenging Obama’s legitimacy as president. Arguments were heard last week on U.S. attorneys’ motion to dismiss the case without going to trial. A ruling from Judge David O. Carter is pending on that motion.

In sanctioning Taitz, Land also wrote that her “misconduct was not an isolated event; it was part of a pattern that advanced frivolous arguments and disrespectful personal attacks on the parties and the Court. …

“In all of counsel’s frivolous filings, she hurled personal insults at the parties and the Court. Rather than assert legitimate legal arguments, counsel chose to accuse the Court of treason and of being controlled by the ‘Obama machine.’ She had no facts to support her claims - but her diatribe would play well to her choir.”

The judge said he doubled the $10,000 fine that he’d previously threatened Taitz with because that earlier amount was apparently not enough to deter continued misconduct.

“While the Court derives no pleasure from its imposition of sanctions upon counsel Orly Taitz, it likewise has no reservations about the necessity of doing so,” Land wrote. “A clearer case could not exist; a weaker message would not suffice.”

        She is going to be sanctioned (probably very seriosly) not only by the Federal Court’s where her complaints are pending, but also by the CA Bar.

        And if she appeals she will be digging herself an even bigger hole, and IMO could be facing a suspension of her law license.

        That probably just means that she decided to go with her law practice rather than keep her real estate license up. There are continuing education and other requirements that take a lot of time and money, which she might not have, since she’s been busy pursuing the Obama matter, and she may have had to make a decision between one and the other.

    Remember, Taitz said she would call for violence if she doesn’t get satisfaction via the courts. Not too funny. It’s time a criminal case was launched against her for incitement to violence, along with threatening and attempting to intimidate federal judges and elected officials. The FTC or U.S. Attorney could also charge her with using phony court cases and fake documents to solicit funds. That’s wire fraud, a felony.

      It is NOT completely funny, if you paid any attention to some posts around the net, who are enraged at the idea that Judges should act legally, in deciding to dismiss.

      One hopes that appropriate people are FULLY AWARE of threats and defiance.

        Well, hopefully she can fall back on one of her other professions since she’s dismal at law. BTW, when did she file a writ of certiori with the Supreme Court on this case? That’s kinda hard to do since the appellate court hasn’t had a chance to review it, so this wouldn’t even be on Robert’s radar screen. And yeah, I’m sure Alito , Scalia and Thomas are just shaking in their boots about having the matter before them. Finally, the Orly Tatiz peanut gallery makes clear that they don’t even bother to learn about how things actually work in our system of government and justice. The seating of a president is a political matter properly situated in the legislative branch of government, not the judicial. Political abstention, where the courts refuse to hear a matter that should properly be before Congress, like this one, is a long standing legal doctrine in American jurisprudence. So stop your blathering, it only makes you look even more foolish.

          The 11th Circuit will consider it because she can appeal a final decision by the district court as a matter of right. But it won’t reverse Land’s ruling because she can’t show an abuse of discretion when it comes to the handing down of the sanction.

    commentary on the idea that impeachment is the job of Congress, and not properly a judicial function.

    The govt is..and has been.. totally satisfied that Hawaii knows a real birth certificate when they see one. The rest of the Federal govt does not rely on websites to define if you need one parent or 27, to be a natural born citizen.
    Courts are for lawsuits. NO LAW HAS BEEN BROKEN.

    The fact of the matter is that we have no Constitution. We have no rule of law. We have a legal system that makes up the law as they go along. It’s called a rule of men.

    Here is but one example.

    United States Constitution,

    Article 2, Section 1, Clause 5.

    “No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.”

    Here is the definition of the term “natural born citizen” as it would have been used and understood by every single delegate to the Constitutional Convention.

    From Emmerich de Vattel,

    The Law of Nations or the Principles of Natural Law (1758),

    Book I, Chapter 19, Section 212. Citizens and natives.

    “The natives, or natural born citizens, are those born in the country, of parents who are citizens.”

    So whether he was in fact born in Hawaii or not, if the United States Supreme Court applied Article 2, Section 1, Clause 5 of the Constitution as it was written and intended to be applied, Mr. Soetoro-Obama would not be eligible to be President of the United States by virtue of the fact that his father was not a U.S. citizen.

    The Constitution is not a living document. It’s a dead letter.

      In any event, If we went by the Constitution as originally written and intended, Obama would also only be 3/5 of a man and have no voting rights either, but thankfully the Constitution IS a living document, don’t you understand what “living document” means? It means it was written with vague statements, and lacked a lot of specifics. Because our founders knew that times would change, and they could not, and should not cement only that which was acceptable at the time it was written. In other words, they expected circumstances to change, and they needed to write is so as it could be interpreted with the changing times. Otherwise, The United States would have been obsolete within 25 years.

      That is what makes it a timeless, living document.

      For another perspective on why Obama IS qualified today:

      “Barack Obama is, in fact, a natural-born citizen of the United States, for the simple reason that he was born on American soil (in Hawaii, two years after it acquired statehood). The age and citizenship status of Obama’s parents at the time have no bearing on Obama’s own citizenship.

      Any confusion on this point is the result of misunderstanding the legal concepts of jus sanguinis (right of blood) and jus soli (right of birthplace). Here’s how the U.S. Citizenship and Immigration Service explains the difference:

      The 14th Amendment of the U.S. Constitution guarantees citizenship at birth to almost all individuals born in the United States or in U.S. jurisdictions, according to the principle of jus soli. Certain individuals born in the United States, such as children of foreign heads of state or children of foreign diplomats, do not obtain U.S. citizenship under jus soli.

      Certain individuals born outside of the United States are born citizens because of their parents, according to the principle of jus sanguinis (which holds that the country of citizenship of a child is the same as that of his / her parents).

      It is a fact that under the provisions of Article Two of the U.S. Constitution, naturalized citizens are ineligible to hold the office of president, but this disqualification does not apply to Barack Obama, who has been a citizen since birth.”

      AKA “natural born citizen”

      In fact, the phrase “natural born” has been a major point of contention for over 200 years. So it’s absurd for Orly to make any definitive claims about the term.

      In an 1862 paper, Attorney General Bates says this about natural born citizens: “We have natural born citizens, (Constitution, article 2, § 5,) not made by law or otherwise, but born.” … “As they became citizens in the natural way, by birth, so they remain citizens during their natural lives…” (Source: Opinion of Attorney General Bates on citizenship: United States. Attorney-General., Bates, Edward, 1793-1869. Washington: Govt. print. off., 1863. Page 8. you can read it on google books)

      Nothing about the birthplace of a person’s parents is mentioned.

      According to a 1988 article by Jill Pryor in The Yale Law Journal (vol. 98 page 881; Natural-Born Citizen Clause and Presidential Eligibility: An Approach for Resolving Two Hundred Years of Uncertainty), the laws that were on the books at the time of someone’s birth determine that person’s status as a natural born citizen. Pryor states that “a child born today would be a natural born citizen if born in the United States or if born abroad to at least one American parent, including American diplomatic and military personnel stationed abroad.” (pp. 897 - 898)

      This is a very long way of saying that Ms. Taitz has no leg to stand on, and her grasp US law and legal scholarship is beyond appalling. Even if Obama *was* born in Kenya, his mom is American, and that makes him a natural born citizen. QED

        Basically the argument is that there is enough ambiguity in the definition to interpret it in multiple ways.

        But the term is broadly interpreted as one born in the US, or one who was designated a US citizen at birth.

    Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

    As a forty year practitioner, I am amazed at that woman’s chutzpah. Hopefully other federal judges will sanction her for her outrageous conduct and the California Bar will begin the process of disbarment. She is truly an embarrassment to this honorable profession.

      Vattel was not an American and he was not a Constitutional Delegate. He was a Swiss Philosopher. The Constituion was written by English lawyers trained in English common law. Under English Common law, if you were born in the country you were “Natural Born” regardless of who your parents were. Even Vattel admitted that that was the case in England (and he wrote that years before the American Revolution).

      In 1898 the Supreme Court of the United States confirmed that under the historic usage of the term natural born and the 14th amendment, any person born in this country is a natural born citizen, even if the parents were not citizens.

      In 1936, SCOTUS reconfirmed this legal tenet.

    A little history lesson. In the latter part of the 19th century, the United States, in one of its less glorious moments, enacted a series of laws known as the Chinese Exclusion Acts. The point of these laws was that Chinese laborers were welcome to come to the U.S. and work but they were denies the perks of U.S. citizenship. In the Wong Kim Ark case, the son of a Chinese couple, who was born in San Francisco left to visit China. When he returned, he was refused entry at the port of San Francisco. He sued, claiming that he was a citizen under the 14th amendment.

    He won the case and the U.S. represented by a Mr. George Collins, appealed the decision, they lost and it was appealed again, all the way to the Supreme Court. As noted above, the Supreme Court upheld the lower courts decisions and ruled that Wong Kim Ark was indeed a natural born citizen (see the above quotes from that opinion).

    Of note is the aregument that Mr. Collins presented to support his case in the Supreme Court. In his written brief, his last and best argument was as follows:

As long as you are a citizen of this country he is your president until another succeeds him. Just because you don’t like it doesn’t mean that he isn’t your president.       In 1958, Hawaii was an organized incorporated teritory of the United States.

      As such it was subject to the full extent of the U.S. Constituion. Anyone born in Hawaii 1n 1958 was as much a natural born citizen of the U.S. as someone born in 1961.

    I have ONE question for all of you!

    Why doesn’t Obama just provide a certified Hawaiian birth certificate to the Court and this whole thing would be a moot issue? I find it amazing that he chooses instead to pay over a million dollars to fight each of the lawsuits.

    Complicating the issue is that he also will not allow his other records to be made public … like his school/college records? It causes any objective person to wonder why and what they contain that has caused Obama to be so secretive.

    What began as a non-issue for the vast majority of people has now changed to a rather large group of people who have become curious. Judge Carter made the most logical statement so far when he said “Let’s decide this issue one way or another, because both parties deserve it to end”. Not sure that was the exact quote, but it has made the most sense so far in this strange chain of events. I, for one, would like it to be resolved right here in Santa Ana.

    As a person who was born a British protected subject, whose birth was governed by British law, how could Barack Obama be a natural born U.S. citizen?

    It is revealing that many on this blog spend their time name calling rather than responding in a civil manner.

    Bryan wondered which documents Obama has not released to the public or to any Court.

    For starters, the original Hawaiian Birth Certificate should be given to the Court and examined by several professionals for authenticity.

    Next, there is a question about how Obama, as a young man with no apparent source of money and using drugs was able to get into the top colleges. Many would like to see his high school and college records, to see if he was qualified and if not why and how he was accepted in Ivy League Universities? We might have learned more about this man if we were allowed to read his thesis.

    He travelled to other countries throughout those earlier years. What passport did he use and specifically where did he go? Yes, there is an interesting conspiracy theory going around the internet about that too.

    BUT, all Obama would have to do to stop all of the conspiracy theories is to release any and all records to the public. If I remember correctly, he campaigned on TRANSPARENCY. Wouldn’t giving permission for all of his records, including his birth certificate, be released to credible sources for authentification demonstrate he is a man of his word?

    And of course the biggest delusional republican non-sense is coming from South OC. Way to support a stereotype Orly! The rest of the OC republicans are better off supporting John McCain and his attempt to take back the party from people like Dr. Taitz, Esq. ;) The republican party has willingly given over a lot of attention and power to people like Taitz, and let Limbaugh and Beck be the spokespeople of the party. Now the party is suffering for it. Time to grab it back, if you can.

    This is why correspondence law schools need to go away. If she had actually gone to a real law school, she would’ve been weeded out by the rigors of a three or four year program. The court’s ruling makes clear that she has no appreciation of advocacy, that she fails to understand her duties as an officer of the court, or even the role that the courts play in our system of government. The courts adjudicate disputes between parties that have a tangible stake in the outcome of the case. They don’t hear cases brought on a whim. Or at least, shouldn’t. Maybe going to a real law school would impart that responsibility to her, and she wouldn’t be acting as such a fool.

    But probably not.

    Latest just in. The Obama fraud goes deeper. Why doesn’t Obama want us to know his heritage? Because he’s not half black! He is 100% Irish. He’s been wearing black face for his entire life so he could take advantage of the Affirmative Action program.
