Updated complaint challenges Obama’s citizenship

There was a lot of interest in this item yesterday about the Santa Ana lawsuit challenging Barack Obama’s citizenship - and his legitimacy as president - so here’s the latest development:
An updated complaint from plaintiffs Alan Keyes and Wiley Drake was filed today. You can see it here.
Yesterday I quoted the Huffington Post as saying that U.S. District Judge David O. Carter on Monday had agreed to hear “the merits” of the case. However, the way has not yet been cleared for the jury trial requested by the plaintiffs.
Plaintiffs got good news on Monday, as Carter could have thrown the case out altogether, according to U.S. Attorney’s Office spokesman Thom Mrozek. Instead, he’s allowing it to proceed to the next step - plaintiffs must serve Obama with notice of the lawsuit, Mrozek said.
I called the plaintiffs’ attorney, Orly Taitz of Mission Viejo, but got a full voice mailbox. I then sent her an email and am awaiting to hear back.
The Annenberg Public Policy Institute examined Obama’s birth certificate firsthand and authenticated it in this report. The rundown includes photographs of the certificate as well as an investigation into evidence presented by those skeptical of the president’s nationality. However, as you can see from the complaint and from the comments to yesterday’s blog item, not everyone is buying Annenberg’s conclusion.

The story I’ve read of Obama’s birth is this; his mother (Stanley) and father traveled to Kenyan when she was in her last month of pregnancy. There they had a falling out and she wished to return to the US., but the airlines during those times refused to allow pregnant women to fly for fear they would give birth while in the air. So she remained in Kenyan until Obama was born.
Obama’s Kenyan grandmother (Sarah) has boasted about (on a tape recording) of being present at the birth in Kenyan. Within days of his birth Stanley returned to Hawaii with Obama and registered his birth there. It was common practice to place an announcement in the papers, either by the family or some staffer at the newspaper who collects public announcements each day (the same way local newspapers report police blotters today).
Since Stanley was only 18 yo at the time of Obama’s birth and her marriage, the citizenship laws stated that “any child born to a woman under legal age of 19 will take the citizenship of the father”.
Stanley was 3 months pregnant when she married Obama’s father and they married against the wishes of BOTH families. Obama’s family felt that she would ruin his educational and career chances. Obama senior was also already married and had to get permission from his current wife to take another according to Luo traditions.
Also the Certification of Live Birth that is posted on Snopes.com says Obama’s father is African, but during the 1960s the term used on birth certificates for blacks was “negro”. (Moderator, please note…..I am not using this term in a negative manner).
Stanely divorced Obama’s father and married an Indonesian man who then adopted Obama, making him an Indonesian citizen. There is no record of Obama ever denouncing that citizenship. Obama was enrolled in a muslim school and his records indicate that he was an Indonesian citizen.
There is also the mystery of Obama’s college financial aid records. Many suspect that he received financial aid after claiming to be a citizen of a foreign country. If he claimed at one time to be a foreigner, there is no record of his ever being “naturalized” as a US citizen.
He also traveled to Pakistan while he was in his 20s. During those years Pakistan was closed to travel for those with US passports. Many suspect Obama used a passport from Indonesia, which would mean he at one time claimed himself to be an Indonesian citizen. Once again, if he did, there is no record that he ever became a “naturalized” US citizen and denounced his former citizenship.
Obama has also had his university records sealed. I’m sure the same people who are curious about the birth certificate are just as curious about how he was approved for a foreign student aid grant.
And, when he applied for the bar he signed a sworn statement that he never used any other name other than Barack Obama, but as we all know, he was known as Barry Obama, Barack Soetoro, and Barry Sotoro.
There are too many unanswered questions in Obama’s background. It’s not just his birth certificate.

Snopes claims (and their evidence suggests) Pakistan was not closed to U.S. passport holders during this time, though there were travel advisories. the rest of your analysis makes sense.
particularly surrounding Obama’s college records, it does not pass the smell test and automatically makes one wonder what there is to hide. if we can see John Kerry’s D’s and George W’s. C’s then why can’t we see Obama’s A’s and B’s? there’s a clear reason why, they don’t want us to know the real truth.

Why was it necessary to verify John McCain’s eligibility to run for president because he was born on a military base in Panama or somewhere but when Obama’s eligibility was questioned there was no verification done? Our Constitution has requirements for candidates and constitutional protocol was ignored. How extreme is that?
I used the link provided in the article to check out the Annenberg Public Policy Institute piece, which purports to authenticate Obama’s birth certificate. Interesting. They present the same “Certification of Live Birth” which many analysts have pointed out is not a birth certificate. This document is not a hospital generate original birth certificate. It does not bear the signature nor does it even identify an attending physician. It lists no birth weight or length. It lists no hospital. It lists the father’s race as “African” a term not in use in 1961 with respect to identifying one’s race. In short, it does not provide evidence of natural citizenship sufficient to obtain a U.S. passport.

2. Therefore, Obama is a US citizen
No, he is not a US citizen, because at the time he was born the law stated that if a married woman under the legal age of 19 years old gives birth the child retains the citizenship of the father. Stanley was 18 years old when she gave birth.
There is also the question as to whether he was born on US soil at all. If you READ THE COMPLAINT you will see there is plenty of reasonable doubt to go forward with the case.
Hope you go broke trying to prove this. It’s my fondest wish…

If you read it in it’s entirety please explain why asking the POTUS to verify his citizenship status not a valid request?

Please respond with your explanation as to why you feel this request is not valid.
Please do not use the reason that his Birth Certificate has already been presented, because the complaint is not questioning whether or not he presented his birth certificate. It is questioning if this birth certificate is one that merely certifies a “live birth” registry or if it is a legal documentation of a natural born birth where a woman had given birth on United States soil as is required by the constitution to be eligible for the office of POTUS.

It would be a valid request, if he hadn’t done it already. Repeatedly demanding an elected official to produce the same document for the personal inspection of every citizen of the United States is not a valid function of the court system.
Where were you guys when we needed to see George W. Bush’s birth certificate anyway? I never saw it. I heard a rumor that it was fake, so I demand my right to see it! It’s a valid request! Ben, The complaint is not asking him to produce the birth certificate, it is asking him to answer questions regarding the certificate he has produced, such as
1) why is there no hospital listed?
2) why is there no official seal?
3) why is there no details on weight, length, etc.
4) why is his father listed as African when that term was not used during the early 60s?

The term “African” was indeed used when Obama was born. You probably mean “African American,” a term that would not appear on Obama’s birth certificate with reference to Obama’s father, as he (the father) was not American. The fact is his nationality ought to read “Kenyan” but Americans, likely both then and now, often seem to think that Africa is a country.
**My eyes are bleeding, so obviously I read the document. It wasn’t easy. The woman is barely literate, and I hope she’s a much better dentist than lawyer. This document is a mess, littered with poor grammar, poor spelling, missing words, etc.

The request is not valid because you and your friends have been presented with proof which you choose to ignore.
Ms. Taitz even bases her claim on the treatise of a Swede, writing in the 1700’s, to account for how US courts should interpret the “natural” or “native” born citizenship requirements for the presidency, going so far as to state that BOTH parents must be US citizens, or the child is not an American. Oh my.

A : Yes, by his own admission.
Q: What passport did he travel under?
A: There are only three possibilities.
1) He traveled with a U.S. Passport,
2) He traveled with a British passport, or
3) He traveled with an Indonesia passport.
Q: Is it possible that Obama traveled with a U.S. Passport in 1981?
A: No. It is not possible.
Pakistan was on the U.S. State Department’s “no travel” list in 1981.
Conclusion:
When Obama went to Pakistan in 1981 he was traveling either with a
British passport or an Indonesian passport.
If he were traveling with a British passport that would provide proof
that he was born in Kenya on August 4, 1961, not in Hawaii as he claims.
And if he were traveling with an Indonesian passport that would tend to
prove that he relinquished whatever previous citizenship he held, British or
American, prior to being adopted by his Indonesian step-father in 1967.
Too bad you have no idea what you’re talking about. I’m sure it won’t stop you though.

Didn’t a court rule on a similar case like this? I recall an attorney on the east coast filed similar lawsuit and it was toss becasue the plaintiff had no legal standing to view the Birth Certificate.

Heres theissue, the birth certificate examined was given from the state of Hawaii, who had issued several thousand birth certificates to those who were born out of the United States.
The reality is, Obama records at Occidental college show he was born I beleive in India, where his dad was from. That’s why the form has been covered up by the college. Anyhow, it will something else if it comes back he was born out of the United States. You will see, he was born outside the US, watch…

What surprises me is that this is not a new question. It was asked when he was running. The Republican Party, with their millions of supporters and even more millions of dollars, did not go this route. Doesn’t anyone else think they would have if it were this easy?

There is no reason to argue with those that believe Obama isnt a citizen. So I will touch on the case itself. The President does not have to prove that he is a citizen, those filing the lawsuit must prove that he does not. His name was on the ballot in 50 states and he was certified as the winner. It would have been the duty of all of those states to be certain that Obama was constitutionally allowed to be President. Either they agree that he is or they failed miserable.
If this case was to win it would be appealed, and likely all the way to the Supreme Court (Just pretend for the sake of argument). This would likely take numerous years and will end up in the same result it is already. The State of HI has certified that he was born in HI. He needs to do nothing but go by that certification.

I just saw the “copy” of Obama’s birth certificate on line. It does not look like mine and I was really born in Honolulu. It’s the way people twist words, such as Gibbs, when they say he has “presented his birth certificate”. Yes, a birth certificate has been presented, but it is not the birth certificate that means anything.
When Politifact.com ran their article stating that they held the actual document in their hands and they can verify that it truly does exist beyond a doubt and it is not fraudulent, that’s all very good and nice, but that still does not clear up the request to see Obama’s LONG FORM Birth Certificate.

Why don’t you try reading your own link. It says what Obama has produced is his official birth certificate. He has met all the legal requirements and is under no obligation to provide you with further information since no matter how much evidence he produced, you would still not believe him.
